TERMS OF SERVICE AGREEMENT

These terms and conditions for using the site www.alexfishingway.com apply to purchase orders for the products/services offered by FISHERWAY SRL through this site.

For proper use of the site, it is recommended to read carefully the Terms and Conditions presented. We reserve the right to modify these Terms and Conditions without prior notice.

1. GENERAL CONDITIONS — TERMS AND CONDITIONS

This website belongs to the company FISHERWAY SRL. By placing an order on the site, the Buyer accepts the Terms and Conditions for the sale of goods and/or provision of services, which are based on the legislation of the Republic of Moldova (hereinafter – Terms and Conditions) and are presented below.

Using the site implies acceptance of the Terms and Conditions proposed by FISHERWAY SRL, in accordance with Law no. 284/2004 'on electronic commerce'. The relationship between the client and the seller is governed by Law no. 105/2003 'on consumer protection' and other regulations adopted in accordance with it. The seller reserves the right to modify these Terms and Conditions, and the Buyer is obliged to follow the changes.

2. PROTECTION OF PERSONAL DATA

By using the website www.alexfishingway.com, you automatically agree to the collection and processing of personal data necessary for processing, confirming, and fulfilling orders. Personal data will be processed only for legitimate purposes, such as providing the products you ordered, conducting promotions, using Google Analytics, cookies, and sending notifications or newsletters.

All information containing personal data is stored and used only for the period necessary to fulfill the purposes for which it was collected and in accordance with the provisions of Law no. 133/2011 'on the protection of personal data'.

We use commercial security measures to prevent unauthorized access, ensure data accuracy, and proper use of information on the site. Therefore, like other companies, we cannot guarantee the security of information provided by the buyer, and the buyer does so at their own risk.

3. ORDER REGISTRATION AND PAYMENT

Payment for orders is possible using a payment card. After confirming the order, a fiscal receipt confirming the payment will be sent to the email address you provided.

Online payment is made in the safest possible environment, using a payment card that allows online transactions. After successfully completing the payment, a confirmation will be sent to your email address.

The payment processor uses a secure system based on the latest version of the 3D-Secure security standard, which represents a new global approach to customer authentication for secure online transactions. This security measure involves redirecting the user at the time of payment to a secure maib page, where the cardholder's authentication is performed using a unique code generated for each online transaction.

Refunds are made only to the payment card from which the purchase of goods/services was made.

To make a payment, you need to enter your bank card details. This information is transmitted in accordance with all necessary security measures. The data is transmitted in encrypted form and stored exclusively on the specialized server of the payment system.

The following details will be necessary to make the payment:

• Card number (16 digits);
• Card expiration date (month/year);
• CVC or CVV security code (3 digits on the back of the card);
• Cardholder's first and last name.

Note: The requested data is used exclusively for processing payments and is processed through a secure system in accordance with international standards for the protection of financial data.

If the card currency differs from the transaction currency (MDL – Moldovan lei), the terms and conditions of the issuing bank apply to the conversion of the debited amount.

4. DELIVERY OF GOODS/SERVICES

Providing a payment link After placing an order, a link for payment of the order placed on the website www.alexfishingway.com is sent to the specified email address.

Accessing a digital product or service Upon successful completion of the payment process, the buyer receives an email containing:

• Access details (login and password) to the buyer's personal account;
• Key for downloading or viewing the purchased digital product (online course/guide);
• Information regarding the date and time of the online service (consultation) to be provided on the Zoom platform, by phone, Telegram, Messenger, or another agreed network.

Changing or losing the email address In case of losing access to the email address used or the need to change it, the buyer must inform the seller in advance to ensure the correct delivery of goods or services.

5. RIGHT OF RETURN

In accordance with the provisions of Law No. 105-XV of March 13, 2003, on consumer protection in the Republic of Moldova, the buyer has the right to withdraw from the purchase within 14 days from the payment moment, provided that access to the digital product or service has not been activated.

As soon as the buyer is provided with access details (login and password) for a digital product (online course/guide) or a service (online consultation) has been provided, the right of return ceases, in accordance with legal exceptions for personalized digital goods and services.

In the case of a valid refund, meaning that the buyer has not been provided with access details (login and password) for a digital product, such as a course or online guide, or in the case where a service, such as an online consultation, has not been provided, the amount paid will be refunded to the card used for payment within 14 days from the approval of the refund request.

6. PRIVACY POLICY

In accordance with the provisions of Law No. 133/2011 on the protection of personal data, the service provider processes personal data. Personal data is processed in good faith, based on and in accordance with legal provisions. The processing of personal data is carried out through mixed methods (automated and manual) in accordance with legal requirements and under conditions that ensure the security, confidentiality, and protection of the rights of the data subjects.

The provider collects and processes only those personal data provided by consumers when placing an order: first name, last name, phone number, address, postal address.

Personal data is used exclusively for managing the website, providing access to special information, delivering orders, or contacting the consumer for delivery execution. Users and consumers are hereby informed that their personal data (first name, last name, phone number, address, postal address) will be processed and used. The service provider processes the personal data of users and consumers, which are provided during browsing, using, and registering on the website www.alexfishingway.com.

Any information provided by users and consumers of the website www.alexfishingway.com will be considered and treated as explicit consent to the use of personal data by the provider.
